It is a shame what has happened.

Shurely the most cost effective action is:
Avoid a claim to your insurer, instead buy 2 old doors off ebay, you will probably find some the same colour, swap them out and live with the scrape on the rear quarter and then drive it into the ground?

Whatv happened to bangernomics?

As I said earlier, I was already looking for something a bit newer so I would've got rid of PHF one way or another. It is convenient for me to have it written off and Adam's insurance can take the hit. I've got a nicer car that will be a bit cheaper to run and I'm totally debt-free too. If I didn't have the money I wouldn't be making a claim and PHF would've been repaired.

I dont understand how he can't be positively identified as the driver and yet you are claiming on his insurance?

The police can't take any action but it is a different matter with the insurance.

This is an illustration of the difference between criminal and civil law, where in the latter a lot less proof is required,
so in this case the police report will show they (the police) believe they have identified the vehicle involved but are unable to prove who was driving.

Whether that will be sufficient for Dave to receive any money is a whole different question altogether :( .

Yes, he has informed his insurance and I've had confirmation through my insurers. The damage to his car (2011 Ford Focus) tallies with the damage to my Picasso. I took photos of the damage to his car which have been e-mailed to my insurers. I might have another independent witness who might have seen Adam driving. I'm not going to push the police side of it any further but it will help with my claim.

But it is proving it.
And even here,Dave saying he had had a few drinks is hearsay. Wouldn't stand up in court at all.
In fact, any claim about drinking could be libellous!

A small update:

I've had a letter from the insurance who reckon that it will be "beyond economical repair". They will be able to confirm this once it has been examined. It is currently at Copart in York. I paid Adam a visit to show him the C4 Grand Picasso. He showed me a letter from his insurers (Octagon) which said that they're unlikely to be able to successfully defend the claim so it looks like they're going to admit liability.

I've spoken to the assessors who have confirmed that RN02PHF is indeed a "total loss" (this is purely in monetary terms) and the settlement is quite a bit more than the £300 that I was expecting so I've accepted the offer. The car is at Copart in York so I'm sure they'll be offering it for sale soon.

How? I saw him before he got in his car. I offered him a lift but he refused. A few neighbours saw him reverse out of the drive where he was parked (over the road from where I live), set off and run into my car without even stopping. When I caught up with him, he was parked outside his parents' house still in the driver's seat with the key still in the ignition. There is damage to the nearside front wing of his car. The insurance are paying me out so how is that dodgy?

Those involved in road accidents have a duty to stop at the scene, to identify themselves to other drivers and to exchange personal details such as names, phone numbers and insurance details.

If the driver fails to stop for some particular reason, such as the situation was unsafe or he felt threatened by the other driver, then they must report the incident as soon as possible, i.e. within 24 hours, at a police station. Failure to do so is a criminal offence.
