What if I fell asleep in the driver's seat?

If the engine was running (even if it was only to keep warm via the heater) that is attempting to drive. If the engine is not running and the keys are not in the ignition, you will probably be found guilty of being "in charge". There is no statutory definition of being "in charge", it is a matter of circumstances and interpretation, depending on exactly what occurred at the time of the alleged offence.

Once the police finally caught up with him I was told that they can't take any further action and in view of what he has done for me in the past (welding & the respray) I decided not to pursue that side of it any further. If he'd stopped at the time we'd have sorted it out between us and he would've repaired the car at his own expense. I'm insured with Hastings and I was never provided with a hire car so I was a bit pushed to find a replacement. The C4 Grand Picasso I bought was the only one that ticked my boxes (2.0 HDi engine in exclusive trim) even though it needed a bit more work that I expected.
