Dear all - advice please!<br>

A couple of months ago, whilst reversing off the pavement to the lowered part of the kerb, a CHAV (19-year-old, not long passed his test, modified Corsa - blacked out windows except the front one but it is partially blacked out with a wide banner that runs along the top of the window screen with 'Dark and Dangerous' on it) went into my car.<br>

I had looked behind me, forward (I live in a Crescent, I had visibility to the end of the road which is about 300 yards away) and behind me again before reversing at about 3 miles an hour. Nothing was coming from either direction. <br>

There were cars parked diagonally from me and our Crescent is very narrow. This guy must have been going at some speed and had tried to squeeze in-between the gap of the parked cars - but he didn't stop!<br>

We swapped insurance details and the work on my car was carried out for which I had to pay a £200 excess.<br>
<br>
I have just called to cancel my insurance as I no longer have the car and have been told that there is still a claim open and as I have been deemed at fault (they cannot prove he was speeding and I was reversing - although he was coming from the opposite direction!), if I cancel the policy I won't get any of my money back (only renewed it in April).<!--EZCODE EMOTICON START >: --><img src=http://www.ezboard.com/images/emoticons/mad.gif ALT=">:"><!--EZCODE EMOTICON END--> <br>

I will be writing to them to dispute their decision about who was at fault but does anyone have any other suggestions or do I just have to bite the bullet?<br>

Transfer....
your insurance to another car...., then cancel it when its all sorted and they've paid the claim.<br>

Sorry to hear about this. Did you have legal expenses cover?<br>

They can't settle it without you at least being asked if you agree (I think, but maybe that's with legal cover). The legal cover will then usually fight for your losses, i.e, no claims.<br>
