ok what do i do EBAY RIP OFF

won a phone on ebay <br>
chap dont accept pay pal so sent a cheque as requested <br>
got 25 feed back all positive <br>
emailed him says he aint seen cheque <br>
just checked my bank cheque been cashed <br>
i know the obvious go and beat the shit out of him smash his windows and take his car <br>
but is there anything else i can do than this as i am a reformed person <br>
these days and dont want to go down that road again <br>
Any help would be appreciated

just incase it's not him could have been cashed by someone else ??? <br>

The Bank will find out who encashed the cheque. YOu will have to report it lost in the post to them, they will then work to return the funds to your account or failing that (i.e funds already gone), contact the Police for an investigation.<br>

Give him the benefit of the doubt for now. There are more thieving scum in the Royal Mail chain than anywhere else.<br>

File a complaint with ebay - under the 'my ebay' section there is the dispute console and you should file a report under item not recieved.<br>

In my experience reporting them to ebay is enough for a refund to be forthcoming or for the item to suddenly appear.<br>

Dont try and pursue other means of recovery until this doesnt work.

hello, I think the best advice is (all be it late) is never send cash or cheques in the post. If he wanted he could have given you his bank details and you could have paid it straight in. I done that once for a mini moto and the moment i paid it in i got para that he was gonna scam me so i worked out a plan of going round his house and caving his head in......needless to say the bike turned up and i became another nutter on a mini moto lol<!--EZCODE EMOTICON START :rollin --><img src=http://www.ezboard.com/images/emoticons/roll.gif ALT=":rollin"><!--EZCODE EMOTICON END--> . You should always look at the payment instructions before you bid if it dont take paypal then i dont bid unless im picking it up. Been to the bank today and they confirmed the cheque was cashed on the 25th<br>
They have requested said cheque back and then they want me to confirm if its ben defaced in anyway<br>
they will also tell me what bank and place it was cashed when they get it back which could take 3 weeks<br>
So what do i do now ?<br>
This chap is adamant he hasnt cashed it
