Photographs Copyright

I was looking for something Sprint related on the web this morning and came across this website:-

To my surprise there are three photographs of SFB which I took just after completing the restoration. I know I uploaded these to the web but can anyone use these photographs without my permission? I thought the person who took the photographs automatically owned the copyright?

Yes, you are the copyright holder and the photos have been used without your permission.

I'd send them a polite email asking them to remove them or where to send your invoice

Not so fast...

Check terms and conditions of any websites you have used to host the photo's. Facebook, for example, relinquish you of any copyright for all images you post on there, by agreeing to their terms (simply by uploading onto their server) you implicitly agree to this!

I often smile when I see commercial photographers post there with a copyright watermark over the image.

Being an 'amateur photographer!!' I looked into this a while ago. You still own the photograph, you just grant them a "non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any [IP] content that you post on or in connection with Facebook". This ends when you delete the photo from Facebook.

But although you own the photo it does mean that they can do whatever the hell they like with it and not be charged once you upload the image!

In reality it just allows them to use the photo internally, on timelines etc...

It's a big topic but you can only assign copyright over in writing (therefore not implied and a website cannot steal it from you, even if you upload it - their terms cannot override statutory law) and, unlike moral rights, you do not have to mark something with a (c) to assert it. Copyright is automatic.

If you feel so inclined, you could send a Cease & Dessist letter, followed by an invoice, if necessary, to: KCR Photography Ltd, 25 Cloven Ends, Langtoft, Peterborough, Cambs PE6 9LF - which appears to run that website.
