Got a demand through for 40 quid fine for not having taxed or SORN'd VA41. [restraint=maximum] A touch irritating that [/restraint].

I find it rather annoying that they can fine me without first having told me if my car is liable for a SORN. I get a V11 for all my other cars but have not received one for VA41. I can't know if it's been taxed since 31 Jan '98. They do know but are under no obligation to tell me before issuing a fine.

What makes me tempted to fight tho is that I paid to receive a keeper history for the car. The covering letter that came with all the photocopies of past V5s states clearly that the 'date of expiry of the last licence [sic] issued' is 31/08/2006. Coincidence that that's the end of the month in which the car became registered to me? I think not. The mere idea that this pile of rust could have achieved an MOT 14 months ago is laughable.

So in short.
1) The DVLA have not informed me whether a SORN is required via a V11, easily sent out with the V5C.
2) When at my expense I made the specific enquiry they provided false information.

Wrong is wrong and I think no 2 would get the case dismissed in about a minute. So do I fight?

As an alternative to paying £40 I can instead pay £29.17 back tax. Is that legal? I'd be implying I've used the car on the road.

I'll probably pay the smaller fine but I really feel I shouldn't. Bliars mob have introduced all these new stealth taxes, I almost feel duty bound to take them to task when the system f##ks up.

I GOT A LETTER ASKING TO RE-SORN THE CAR,BUT THE LETTER SAID "THAT IF I WAS NO LONGER THE KEEPER,TO IGNORE IT AND THEY WOULD SEND A LETTER TO THE NEW KEEPER."OBVIOUSLY THEY HAVEN'T.
I WOULD TAKE THEM TO COURT,I AM TAKING MY BANK TO COURT.THEY ARE USELESS TOO.

Definitely fight it. If they had sent you a new V5 and didn't mention it then it's pretty bloddy shoddy.

If as the vehicle keeper you keep your vehicle off the public road because it is untaxed, you must tell the Driver and Vehicle Licensing Agency (DVLA) immediately. This is known as statutory off road notification (SORN).

You only need to declare SORN for a vehicle that had a tax in force on or after 31 January 1998. There is no charge for declaring SORN.

the DVLA vehicle licensing website should tell you the expiry of the last tax/sorn. If it has been sorn'd since 1998 then it counts as taxed.

FIGHT FIGHT FIGHT, i like a good goverment scrap.

Strangly i was talking to Len Hughes tonight about this. he has had problems with his sprint that was taxed but was 'fined' for not declaring sorn 6 months after taxing it!!

i keep getting sorn fines for a car i owned for 2 hours a couple of years ago, after getting the car i sold it on, filled out the v5 , it since has had three owners and is now mot'd, insured and taxed but i still got a sorn fine not not declaring this years! i have now given up making loads of calls to sorn dept and dvla so the latest one got filed.

Hadn't tried that site, it was down on Friday evening. It says 01/09/2006.

The car has been in my care since 1/8/05 and has not been presented for MOT since then so there's no way a license can have expired on the 31/08/06.

They really are clueless. They havn't even managed to register it in the name I gave them on the form, they've misspelt my middle name.
